I'm seeking second opinion for my situation.
My H1b visa has been extended for another 3yrs and my current stamped visa expires sept 2010. I work for a typical consulting company with a client at end and a vendor in the middle. I've a clean record and have been paid always for last 3yrs, without a single month gap.
I'm visiting India in June for marriage so I wanted to go for the stamping as well. I've a situation where I'm looking for a second opinion.
What would you do if you were in my situation:
1. Go for visa stamping alone immediately after landing in India before marriage. Marriage is about 8-9 days after I land there. And, my spouse can go for H4 visa alone after marriage once marriage certificate is ready.
2. Go for visa stamping after marriage with spouse as well. But I'll have only 7-8 business days based on the latest dates available after marriage.
3. Don't go for stamping as I can return with a valid visa and I-797. My spouse can go alone after.
I'm tending towards #2 just because if I do get stuck for some reason, I doubt they will process my application within 2-3 weeks without needing to alter the travel plan when I go with #1. So, either #1 or #2, if I've a situation in stamping then I doubt anything will get settled just in 2-3 weeks.
I want to go with my wife just because I'll have one less work to get done and we can plan her transition from existing job.
What will you do given same situation? Any risk that you see?

Most of the records are kept for 3-7 years in any organization, Based on that it seems unlikely that they will have the copy of I-94. You can try, you may succeed.

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

Note that EAD is not a valid document for re-entry.
If you have a valid AP - you can re-enter
or
If you have a valid H1/H4 AND un-expired visa stamping - you can re-enter
I had my H1 extension pending and I was able to re-enter using AP (on July 18, 2008 at San Francisco)
She has the F1 stamped on the passport which is valid until Dec 2009 I think. She is finishing much before that. Does it mean she will not be able to reenter on either F1 visa or the EAD?

Need quick suggestion:
Company A filed for GC. Labor and I-140 was approved. I-485 was filed during July 2007.
I changed employer in June 2009; replied to RFE and filed AC21 in July 2009.
I came to know that my GC sponsring company is going to close the company soon. My current immigration attorney is suggesting that if that happens; and if INS came to know that GC sponsring company is closing down, they will revoke my I-140.
Is it true? I thought after AC21 is invoked; whatever happens to GC sponsring company, it will not impact my GC application in any way.
Please advice.

Your I140 cannot be canceled/revoked unless USCIS detects that it was obtained fraudulently.
Your GC application will not be impacted. Just find another employer and join them with EAD.

Hi,
Got a 1-797 Notice of Action today in Mail for my pending I-485 and the Notice Type: WELCOME NOTICE: SECTION: Adjustment as direct beneficiary of immigrant petition.
In the details section it says" Welcome to United States"...your application for permanent residence has been approved...we will soon mail you a new Permananet Resident Card....
HOWEVER, the online status still shows "Case pending" and NO LUD update.
1. Any reason to get concerned as the online case status still show it as Pending altough I see approval in Mail Notice?
2. Should i call customer service?
3. How long typically the card in mail takes?
Congratulations!!!
Online updateds are done in batch jobs in the night.
So i guess you should see change in online status tomorrow if not call customer service.

I lost my job about a month ago with fortune company where I had my H1 and then I filed to transfer my H1 to the GC filing company. It got approved last week. They even seem to have sent the I 94 with the H1 approval.
I have a visa from the earlier company(fortune company) till dec 2009 in my passport. Do I now need to get a fresh visa again with the new (GC) company that has sponsored my H1. Or is the visa validity in my passport is good enough to work even for the new employer?
