Hi everyone,
I am flattered and extremely grateful to all of you for thinking about this. However, Immigration Voice has made it a policy to use the funds available for advocacy and in order to do that we have chosen not to reimburse expenses for anyone. We will in future, change this policy and reimburse expenses for travel and stationary if it is affordable to do so without running short on funds for advocacy. There are a lot of people who have spend money from their pocket on this effort. Recently, Gopal, Tamsen, Anand and many other had spent money to organize rally and make the banners for San Jose rally, Jay have traveled to DC multiple times on his expense, Himanshu, Vineet, Pratik, Ashish, Nagaraj, Naren, Alok and other members of the core team have all spent resources from their pocket. And there are a lot of good non-core group members who have kept the faith and have spent from their pocket and writing all their names will fill up many pages of this thread.
If I am unable to get reimbursed then I would not regret at all because I truly believe that every penny was worth the effort and I am lucky that I could do this for myself and this community. This community is not about one person, it’s about all of us and it’s about this broken system. I am nobody as an individual but we are collective a very big community. We need to stand up for ourselves so that few lawmakers will not take pride in beating us down by their false rhetoric on the Senate floor. As you have witnessed lately, these lawmakers think that beating us down is like a low hanging fruit and every time they need to improve their ratings, they could simply do some empty rhetoric. And when we all stand-up for ourselves, together, it will be time for this bigotry to end.
Please do not collect or send funds with the intention of reimbursement for me or any particular core group. Please continue contributing to our organization in whatever capacity you can. Please become more active in the state chapters. In the beginning the response will be slow and sometimes discouraging. But if you are persistent, you will be able to motivate others in your area and raise the level of participation of other members. Please stand up for yourself and not expect lawyers or employers to do “something” for you. For too long a lot of people have taken advantage of this community. Some lawmakers have even taken pride in beating us down, knowing well that we do contribute towards the progress and pay the taxes and do our due share in the society. We all need to realize that it doesn’t end with whatever we have been doing at our jobs, because if we want our issues to be addressed we have to organize and act as community. And there is nothing wrong with organizing a community. We all have witnessed our strength when we all collectively acted as a community responding to the recent visa bulletin fiasco. We won because of the participation of everybody who sent flowers, participated in the rally and participated and helped behind the scenes in these activities.
So please keep this in mind. For the core group, your involvement is as important as your contribution. Participating in phone campaign, fax campaign, flower campaign, street protests, video campaign -- all this is a billion times more important for our success. Contributions are also welcome but your presence on the street and your face on the videos is of paramount importance for coming months. Please follow every single action item both on this site and the ones you get in the newsletters. In order to get newsletter, keep the email address and contact information in your profile (of IV account) up to date.
My wife and I received our green cards in June. But all it doesn’t end with a green card. We will all continue to have same set of problems. This IV generation will be facing same set of problems in the future, regardless of the country of origin. The question is, do we form a new organization from scratch whenever a problem knocks at our door or do we continue to be part of an effort which can take on any challenge for this community. So if you have received your green card or if you are at any stage of the process, in the long term, we should all act as a community to see greater things happen for all of us.

GCStatus did not mention anything about Labor or I-140 fees here. Nor did he mention, he paid them.
He refers to all the DOLLARS he has paid for , which means, all EAD and AP renewals ( For self and spouse) , Additional Lawyer fees incase of incorrect NOID, additional Bio-Metrics fees.
Wait till you hear the actual Lawsuit. Long way to go. But your post helped us to clarify what we are talking about to rest of the folks like you, incase, they misinterpreted the information.

I have a unique position. couple of weeks back I was told that have fatal cancer and won't live pass 4-6 months. After recovering from initial shock I am wondering if my wife will be able to continue her american dream or she will have to head home after me.
I have filed 485 with approved 140 back in june, 2007 with PD of March, 2003

On a serious note, there have been 4 cases approved today(from other site - 2 cases from India and 2 from ROW). So looks like there are some ROW applications also in queue during this time of the year getting approved. I saw someone from EB2-ROW getting 485 approved (filed 140/485 concurrently) in a record time of just 30 calendar days(Filed on July 26th and approved Aug 25th). Never heard USCIS was so efficient.
Looking at the positive side, since they are still approving ROW cases, it may mean that spillover is still happening and there are visas available.

You might need additional documentation only in cases of RFE. In most cases there are no RFEs. I know a friend of mine was job less for a year and changed 2 jobs under AC21(with different salary ranges ) after applying 485. Never informed USCIS (I guess it is not mandatory). He got his GC recently. He probably would have faced difficulty if there were any RFEs.
One should be okay as long as the following are met :
1) 180 days sice I485 RD
2) Approved I140 (Some say approvable , but safe it is already approved)
3) New job is substantially similar.
Again it was not clearly defined what is substantially similar and I don't think there is any hard and fast rule about the salary changes. That leaves a lot to the discretion of the adjudicating officer. That is why it is important that (s)he trust the original intent of the beneficiary to join the employer and employers intent to recruit the beneficiary.
There must be a memo with some clarifications in this regard.
My 2 cents :)

Equating labor substitution with porting is real silly. Labor substitution was clamped down, because of abuse, however it didn't mean that it was wrong by its very virtue. However the abuse lead to its closure.
As for porting, I don't see any scope for abuse. Cuz the process is in such a way, that one has to refile labor, 140, and all the exact procedures similar any freshly new EB-2 candidate would. The only difference is that at the end, one has option to request his/her earlier date.
And rightly so, because there's a difference between two Eb-2 filers. One who has not filed anything before, and one has filed "SOMETHING" before. That "something" holds the merit.

You are in this society for 35 years, so I'm not sure what's your objective of being on this forum...Anyway about your observation on Visa spill over, what you are saying is 180 different tha what other lawyers are saying, they are saying until 2007 DOS was reading the law differently so India was getting the spillover Visas, now they have started reading it differently hence India is not getting more than 7% Visas now, it is very obvious, from EB-3 India being in Oct-2001 for last 2 years, and EB-2 haven't seen any substantial movement either....
That is many peoples problems isn't it? They are active on forums, care about greencards, keep abreast on legislative stuff and then once they get greencard they disappear.
If someone is from USA and they go to your country and live there for five years; they do not have historical context of why things are done the way they are done; no matter how long they research it.
We'll see when statistics come out. Which lawyers by the way say their interpretation is 180 degrees different?

From October 2005 to September 2006 (it was around 10,500)
For the period October 2006 to September 2007 (someone want tofind it; it was more then 7%)

Most likely the majority of Americans have immigration roots from somewhere, like anybody else. I don't think that would be a compelling argument though. The US allows 1+ million to immigrate here every year.
Rbharol, what really messed up for us is the high influx of illegal aliens. We, the Employment Base greencard applicants represent a small group. We used to be respected few years ago. We are not visible at all, even when we get stuck. It is understandable that the illegal aliens abused the system and we are paying the price for it. I am sorry but that is true. People generalized and we are now in the middle of this mess. It happens that after I posted this, I found the article below which reinforces my sad perception:
